Official Statement Regarding PS3 Circumvention Devices and Pirated Software

Today, Sony Computer Entertainment released the following statement:

Notice: Unauthorized circumvention devices for the PlayStation 3 system have been recently released by hackers. These devices permit the use of unauthorized or pirated software. Use of such devices or software violates the terms of the “System Software License Agreement for the PlayStation 3 System” and the “Terms of Services and User Agreement” for the PlayStation Network/Qriocity and its Community Code of Conduct provisions. Violation of the System Software Licence Agreement for the PlayStation 3 System invalidates the consumer guarantee for that system. In addition, copying or playing pirated software is a violation of International Copyright Laws. Consumers using circumvention devices or running unauthorized or pirated software will have access to the PlayStation Network and access to Qriocity services through PlayStation 3 system terminated permanently.

To avoid this, consumers must immediately cease use and remove all circumvention devices and delete all unauthorized or pirated software from their PlayStation 3 systems.

What this means to you

Circumvention devices and game piracy damage our industry and can potentially injure the online experience for you, our loyal PlayStation customers, via hacks and cheats.

Many PlayStation.Blog readers have asked how we intend to deal with these incidents that they have been reading about in the gaming press, and this is our initial response.

By identifying PlayStation 3 systems that breach our guidelines and terminating their ability to connect to PlayStation Network, we are protecting our business and preserving the honest gameplay experiences that you expect and deserve.

Rest assured, this message does not apply to the overwhelming majority of our users who enjoy the world of entertainment PlayStation 3 has to offer without breaching the guidelines detailed above, and we urge you to continue doing so without fear.

  • This is a win for sony. I know Sony is going to look at that Mac and IP Address to track that console to the fullest who has bad software installed on it.

  • Gee you guys! Since there are “so many” CFW users who don’t pirate or cheat, maybe Sony should just make a special case for all CFW users and ask them personally if they pirate or cheat. Then all the CFW users have to do is select “No” and they can sign onto the PSN and be on their merry way!

    Because absolutely everyone with CFW is a virtuous, upstanding citizen, right?

  • I bought my PS3 used online about a month ago. I don’t know if the previous owner used any of the circumvention devices but I got this email. I installed 3.55 firmware as soon as I got the ps3 online and proceeded to update to 3.56 because I play online often. I don’t know if my console will get banned because I don’t have a circumvention device and they are detecting that I do.

    There’s a balance between those who earn their keep by providing this entertainment, and those who spend their well-earned money to enjoy the life PlayStation. If Sony needs to go on the attack to protect this balance, then Sony, full attack!

  • While I midly support Sony’s fight against piracy (Better security – GOOD, fugling up everyone else in the process AKA no PS2 emulation and otherOS support – BAD), I find it a shame to directly link PS3 modders / etc. to hackers that ruin online games, no matter what the platform. Take a look at PC gaming, legit users BUY hacks. Doesn’t mean if your are legit that you actually ARE legit.

  • So Sony, I haven’t used my PS3 in about a year. I sign-on to MW2 and the second server I play on unlocks my level 17 toon to 70 and unlocks all the guns. I’ve deleted saves and I can’t get rid of it. Am I now technically hacking/cheating? Will I get banned?

    If so, you need better control of your servers. Just sayin’.

    spoils it for the bunch.

    Sony should do filmware updates every month, like microsoft does with there computers that way it will all content fresh and piracy proof.

    No I never play online. When I first go the system, but not anymore. I agree people that CHEAT should get a suspension, but people that RE their OWN system they they bought with their own Money. Why should they get banned? Just because someone has CFW installed does not mean they are pirates or cheaters. Actually most of those people are just happy that they have OtherOS back. But you who paid for the system that was supposed to support linux will never have that opportunity again. Read the link and see what your almighty Sony does with your data.

All intellectual property rights therein belong to SCE and its licensors, and all use or access to such System Software shall be subject to the terms of this Agreement and all applicable copyright and intellectual property laws. Except as expressly granted in this Agreement, SCE and its licensors reserve all rights, interests and remedies.”

    For you and OtherOS gripers: Get over it. Its not Sony’s fault if you don’t want to read the agreements when you connect to the online aspect or update the firmware on your system.
    Sony doesn’t owe you anything. So get over it.

  • They install spyware on your system. And they do not encrypt any of your data. Which means ANYBODY could very easily get your info if they wanted it.

  • I never signed an Agreement. Not to mention it has been recently changed without end-users knowledge which makes it void. Do some reading somewhere other than Playstation Blog. The fact is Sony is setting a double standard how are you gonna argue that? They stole LG’s technology thats that. Sony is running pirated hardware on their own machine. And thats ok for Sony to steal? Wake up!

  • I hate piracy, I hate cheating, but I support Homebrew. As a legitimate user you already cut me off PSN because you removed the very important feature OtherOS(one of the biggest reasons for me to buy the PS3 back then, next to the bluray player, games was a nice + (I do have over 100 original PS3 games now)), so I’m still on OFW 3.15 because I want to keep my OtherOS, BUT you (sony) force me to use the current Customfirmwares if I want to be able to use my PS3 with the functionalities when I bought it (so being able to use OtherOS, play the latest games and go online), Now you say you will ban ‘me’ if I do, so what’s the difference for me as a legit customer still on OFW 3.15(except that with CFW I can actually play the latest games)?

    I do think cheaters should be taken care of, but if someone is using homebrew (non-cheating, non-piracy, non-PSN-damaging) it should be allowed (and even encouraged, just like Microsoft has it’s XNA-studio), as it can only enrich the PS3 functionalities which are sadly to say very bad/lame.

  • @dd_900: You talk continually about hacker’s and their rights, and yet for all the talk, I don’t see one thing in your yapping that isn’t covered in the rights and agreements that Sony puts in writing before you use their product. Because I would dare you to bring your arguments to court against Sony and see how your nonsense holds up. I personally have nothing to worry about with Sony looking in my system, but apparently you must. Because that aspect of Sony peeking in your system is ALSO written as an agreement you have to go by if you want to continue using their online service.

  • like I said the agreement now is way different then when i first bought the system. Did they inform anyone of the change? no they didnt and you cant just change an agreement without notifying everybody. Void. Face it Sony blows they steal and you support that?
